Artificial intelligence (“AI”) refers generally to the broad science of mimicking human abilities. AI technology can today power self-driving car systems, manage our schedules or spot signs of certain diseases. The dynamic growth in the AI field is generating new legal challenges in areas of intellectual property law.

Existing laws were not built to address the issues created by AI’s rapid development. The preponderance of AI has raised intriguing issues such as whether AI may be considered an “author” and whether its creations qualify as “works” in the context of copyright laws. Should AI-generated works be entitled to the same protection as works of human origin?

Also, how, if at all, does AI impact trademark law? In addition, there are a large number of individuals that contribute to the process of creating, designing, developing and producing the AI systems themselves. In light of these circumstances, one of the pressing issues is who would have ownership in the intellectual property arising from these AI-generated inventions/works?

What are some of the legal issues to be considered when looking at entering into contracts in relation to AI technology?

Speaker

Adraea M Brown is assistant general counsel for trademarks at Harley-Davidson where she leads the company’s in-house trademark team and serves as Vice President of H-D USA, LLC — the owner of all Harley-Davidson trademarks. In her role, Adraea oversees the company’s 5,000+ global trademark portfolio, brand protection and enforcement, and trademark litigation. Adraea also provides legal support and counsel to the company’s multimillion-dollar licensing and strategic brand alliance programmes.

In her time at Harley-Davidson, Adraea was instrumental in helping the company obtain its largest-ever damages award against a single infringer in the amount of USD19.2 million. She also led the legal support of strategic licensing relationships with Tuscany Motor Company for Harley-Davidson-branded Ford pickup trucks and LEGO for a Harley-Davidson® Fat Boy® toy motorcycle.

Adraea joined Harley-Davidson in 2015 as trademark corporate counsel and was promoted to senior trademark counsel in 2018 and to her current role in 2019. Prior to joining Harley-Davidson, Adraea was an associate with the PLK Law Group, a boutique trademark and copyright law firm in Hillsborough, New Jersey.

Adraea is a mentor in the Big Brothers Big Sisters of Metro Milwaukee Mentor 2.0 programme. She earned her Juris Doctor from the University of New Hampshire School of Law (formerly Franklin Pierce Law Center) and her Bachelor of Arts degree from Spelman College, Georgia.

Benjamin Gaw is a Director in the Corporate and Mergers & Acquisitions Practice Groups, as well as Head of Healthcare & Life Sciences (Corporate & Regulatory) at Drew & Napier. He is also a member of the firm’s TMT and Information Technology Practice Group and the Employment Practice Group.

Benjamin is an endorsed lawyer for information technology law by Best Lawyers International: Singapore (2021 Edition). He is recognised as a market-leading lawyer for Corporate/M&A by Asialaw. He is also recognised as a “Global Elite Thought Leader” for life sciences by Who’s Who Legal 2020. Benjamin regularly acts for and advises clients on a wide spectrum of mergers and acquisitions and other transactional and corporate and commercial matters. These matters include sale and purchases of companies and corporate assets, amalgamations, joint ventures, shareholder agreements, corporate restructuring as well as general commercial law.

In relation to technology and corporate intellectual property matters, Benjamin regularly advises on legal issues in the commercialisation and exploitation of intellectual property (“IP”) rights, such as research and development agreements, IP licensing and cross-licensing agreements, IP assignments, and also franchises and franchising businesses. Benjamin also regularly reviews software licensing agreements, IT procurement and related contracts, website terms of use, and other IT and technology contracts. He also advises on start-ups, early stage investments in technology companies, initial coin offerings (“ICO”) and other fintech matters.

As Head of Healthcare & Life Sciences (Corporate & Regulatory) practice at Drew & Napier, Benjamin advises on a full spectrum of matters involving the biotechnology, medical devices, healthcare, and pharmaceutical industries. His experience includes reviewing and drafting clinical trial agreements, patient access programmes, research and development agreements, review of compliance policies, advising on regulatory and ethical concerns, including data and personal privacy concerns especially in the healthcare sector, product liability issues, and product recalls.

Benjamin’s practice also includes a strong emphasis on employment law, and he regularly advises clients on a range of employment issues arising from the course of an employment relationship, from hiring to talent development and retention, and exit management. These include preparing and reviewing the employment contracts and handbook templates, promotion letter templates, sponsorship agreements for its employees and termination agreements.

Event Policy

Places are limited and registration is on a first-come, first-served basis.

For events with registration fees, all payments must be made in advance, including bank charges. Registration will be confirmed once proof of payment is provided by email or fax, and full payment is received.

For events that are not organised by Bar Council, please note that you are subject to the relevant terms and conditions specified by the external providers.

Cancellation 

Cancellations must be made in writing.

If you have failed to inform the organiser on your cancellation for three consecutive times, you may be blacklisted for future events.

Refunds 

Refunds will be processed after the event is completed. This may take up to 30 business days. The conditions for refunds are as follows:

  • Full refunds will be issued if the event is cancelled or postponed by the organiser due to some circumstances.
  • No refunds for this course. However substitution is allowed.

The organiser reserves the right to modify, cancel or postpone the event, should circumstances arise that make such action necessary, whereupon all registration fees paid will be refunded.

Transferral

You are allowed to transfer your place to another participant, but you must notify the organiser with the necessary details.

Attendance 

CPD points will not be awarded to lawyers and pupils in chambers from Peninsular Malaysia who arrive more than 15 minutes late, are not present throughout the event, or leave before its scheduled end.

Privacy 

The personal information that you provide to the Bar Council, whether now or in the future, may be used, recorded, stored, disclosed or otherwise processed by or on behalf of the Bar Council for the purposes of facilitation and organisation of this event, research and audit, maintenance of a participant database for the promotion of this event, and such ancillary services as may be relevant.
