Description
Mediation is supported by effective mediation advocacy. This talk is intended to help participants understand their role as advocates in preparing clients for mediation, and to manage and assist the mediation process. The speakers will address the growing trend of mediation as well as share their thoughts on mediation from the perspective of mediation advocates. Special focus will be given to the practical aspects of mediation advocacy.
Speaker
Kuthubul Zaman Bukhari has held various positions as an Office Bearer of the Malaysian Bar: Secretary from 2000 to 2002, Vice-President from 2002 to 2003, and President from 2003 to 2005. He is currently the Co-Chairperson of the Bar Council Alternative Dispute Resolution Committee. He has also chaired the Arbitration Committee, which was involved in the initial drafting of the new Arbitration Act 2005. He is the Chairman of the Malaysian Mediation Centre (“MMC”), which was set up by the Bar Council in 1999, and served as Chairman of the Asian Mediation Association from 2011 to 2013.
Shanti Abraham has practised as an advocate and solicitor in both Singapore and Kuala Lumpur. She has a mixed practice of civil dispute resolution, and local and international corporate work. She is a certified mediator with the MMC and the Singapore Mediation Centre, and is a also a trainer at both centres. She is a healthcare mediator in Singapore and has been appointed as a mediator in ad hoc matters. She is a mediator with the Kuala Lumpur Regional Centre for Arbitration (“KLRCA”) and at the Securities Industry Dispute Resolution Centre.
She has was accepted to participate in the Program on Negotiation entitled “Advanced Mediation: Mediating Complex Disputes” in Harvard Law School in 2017.
