Description
As there are more conveyancing lawyers compared to litigators and commercial lawyers, the conveyancing practice has produced the highest number of complaints received by the Bar Council from the general public, the highest number of professional indemnity insurance (“PII”) claims and the highest number of disciplinary actions.
Non-compliance of the Solicitors’ Remuneration Order (“SRO”) is a misconduct and non-compliance may void PII cover.
The speaker will highlight and discuss the many issues and problems faced by conveyancing lawyers on how to charge fees under the SRO, such as:
1. Meaning of non-contentious business;
2. Basic principles on how to charge fees;
3. Can a solicitor charge more than the prescribed fees under the SRO?
4. How to apply the discount of up to 25% of fees prescribed under the SRO;
5. What is included and not included in the prescribed fees;
6. What are disbursements reasonably and properly paid and incurred?
7. Transactions under the Housing Development (Control & Licensing) Act (Act 118);
8. Waiver of fees;
9. Consequences of non-compliance;
10. Transactions under the First Schedule to the Sixth Schedule; and
11. When are transactions completed?
Participants will participate in the webinar by answering some workshop questions.

Andrew Wong was called to the Malaysian Bar in 1978 and was a member of the Bar Council from 1987 to 1989. He was the Chairperson of the Bar Council Conveyancing Practice Committee (“CPC”) from 2008 to 2010 and the Chairperson
of the Solicitors’ Remuneration Enforcement Committee (“SREC”) for many years.
He was a member of the Solicitors Costs Committee (“SCC”) constituted under section 113 of the Legal Profession Act 1976, when the SCC made the latest SRO 2023 [P.U.(A) 207/2023], which came into force on 15 July 2023. Andrew is currently a member of the CPC and the SREC.

Event Policy
Places are limited and registration is on a first come, first served basis. Registration will close at 12:00 pm, on 10 Nov 2023 (Wednesday).
Please note that no additional registration will be accepted once the closing date has passed, or if the seminar is full (whichever comes first).
We may not permit future registration if you fail to attend the seminar after registering, unless you provide an acceptable and valid reason(s).
For events with registration fees, all payments must be made in advance, including bank charges. Registration will be confirmed once proof of payment is provided by email or fax, and full payment is received.
Cancellation
Cancellations must be made in writing.
We may not permit future registration if you fail to attend the event after registering, unless you provide an acceptable and valid reason(s).
Refunds
Refunds will be processed after the event is completed. This may take up to 30 business days. The conditions for refunds are as follows:
- Full refunds will be issued if the event is cancelled or postponed by the organiser due to some circumstances.
- No refunds for this course. However substitution is allowed.
The organiser reserves the right to modify, cancel or postpone the event, should circumstances arise that make such action necessary, whereupon all registration fees paid will be refunded.
Transferral
You are allowed to transfer your place to another participant, but you must notify the organiser with the necessary details.
Attendance
CPD points will not be awarded to lawyers and pupils in chambers from Peninsular Malaysia who arrive more than 15 minutes late, are not present throughout the event, or leave before its scheduled end.
Privacy
The personal information that you provide to the Bar Council, whether now or in the future, may be used, recorded, stored, disclosed or otherwise processed by or on behalf of the Bar Council for the purposes of facilitation and organisation of this event, research and audit, maintenance of a participant database for the promotion of this event, and such ancillary services as may be relevant.
