Description

Matters involving fraud, forgery, fraudulent misrepresentation and breach of fiduciary duty are relatively common in Malaysia. Some examples include:

  • Diversion of funds from a company (public or private), society or partnership;
  • Diversion of business to the wrongdoer’s own nominee;
  • Diversion of stocks and parts;
  • Sale of real property to the wrongdoer’s own nominee at an undervalue;
  • Purchase of assets from a third party at a premium with a kickback to the wrongdoer as arranger;
  • Signing contracts with a third party at a premium with a kickback to the wrongdoer as arranger; and
  • Use of false consultancy agreements, management agreements and distributorship agreements.

These acts may usually be committed by an officer of the said company, society or partnership, with the assistance of other individuals within the same entity and / or external professionals. These may include valuers, solicitors, liquidators, receivers, accountants, auditors, managers, consultants and other industry experts. Such misconducts occur across a variety of industries such as construction, marine, oil and gas, information technology, manufacturing and plantation.

The seminar will cover the fraud, forgery, fraudulent misrepresentation and breach of fiduciary duty matters across various industries; and the evidence-gathering process involved.

Speaker

Mohd Izral Khairy leads Izral Partnership. He is a tenacious lawyer with experience as counsel at all levels of Court and arbitration.

Izral frequently advises multinationals, government-linked corporations, public listed companies and individuals on issues relating to fraud, breach of fiduciary duty, breach of trust, directors and shareholders issues, contractual disputes, negligence and defamation, schemes of arrangements and challenges faced by distressed companies. The industries that he frequently advises are oil and gas, construction and infrastructure, and media.

Event Policy

Places are limited and registration is on a first-come, first-served basis. The registration for this session will close on 4 August 2025 (Monday), at 12:00 pm.

For events with registration fees, all payments must be made in advance, including bank charges. Registration will be confirmed once full payment is received and proof of payment is provided by email or fax.

The organiser reserves the right to modify, cancel or postpone the event, should circumstances arise that make such action necessary, whereupon all registration fees paid will be refunded.

Cancellation

Cancellations must be made in writing.

Please note that there will be no refunds for cancellations, but substitutions are allowed. Kindly inform us in writing with the relevant details at least three days in advance.

If you have failed to inform the organiser on your cancellation for three consecutive times, you may be blacklisted for future events.

Transferal

You are allowed to transfer your place to another participant, but you must notify the organiser with the necessary details at least three days in advance.

Attendance

CPD points for CPD Scheme will not be awarded to lawyers and pupils in chambers from Peninsular Malaysia who arrive more than 15 minutes late, are not present throughout the event, or leave before its scheduled end.

Privacy

The personal information that you provide to the Malaysian Bar, whether now or in the future, may be used, recorded, stored, disclosed or otherwise processed by or on behalf of the Malaysian Bar for the purposes of facilitation and organisation of this event, research and audit, maintenance of a participant database for the promotion of this event, and such ancillary services as may be relevant.
