CPD Legal Learning Lab | Islamic Finance – Maqasid, Legal Practice and Contemporary Challenges

This session will examine Islamic finance through the lens of legal practice, with particular emphasis on the application of maqasid al-shariah in structuring and documenting Shariah-compliant transactions. It will explore how the objectives of Shariah — fairness, transparency, risk allocation and preservation of wealth — shape modern Islamic finance beyond mere technical contract compliance.

The talk will highlight practical issues commonly encountered by lawyers, especially younger practitioners, when advising on and preparing Islamic finance documentation. These include translating Shariah concepts into enforceable legal rights, navigating exit mechanisms and guarantees, managing commercial pressures, and aligning legal form with Shariah substance.

The session will also provide a concise overview of key Shariah contracts applied in Malaysia and the related legal and regulatory considerations under the Malaysian Islamic finance framework. It will conclude with a brief discussion on Islamic social finance, including its growing relevance during periods of economic uncertainty and how lawyers can contribute to structures that are both commercially viable and socially impactful.

Overall, the session aims to enhance practitioners’ understanding of Islamic finance as a value-based legal discipline and to reinforce the lawyer’s role in upholding its integrity in practice.

Speaker

Sharifah Shafika Alsagoff is a partner in Zaid Ibrahim & Co. She has more than 28 years of experience in Islamic finance, investments and capital markets.

Sharifah’s practice is diverse and she has advised on matters ranging from retail and corporate finance to project finance, social finance, sukuks, private equity investments, and real estate acquisitions and disposals.

She is also active in public engagements, both locally and internationally, through talks, seminars and training sessions on Islamic finance and Shariah-compliant investments for government-linked and private institutions.

Terms and Conditions

Event Policy

Places are limited and registration is on a first come, first served basis. The registration for this session will close on 8 June 2026 (Monday), at 12:00 pm.

For events with registration fees, all payments must be made in advance, including bank charges. Registration will be confirmed once proof of payment is provided by email or fax, and full payment is received.

The organiser reserves the right to modify, cancel or postpone the event, should circumstances arise that make such action necessary, whereupon all registration fees paid will be refunded.

Cancellation

Cancellations must be made in writing.

Please note that there will be no refunds for cancellations, but substitutions are allowed. Kindly inform us in writing with the relevant details at least three days in advance.

If you have failed to inform the organiser on your cancellation for three consecutive times, you may be blacklisted for future events.

Transferral

You are allowed to transfer your place to another participant, but you must notify the organiser with the necessary details at least three days in advance.

Attendance

CPD points for the CPD Scheme will not be awarded to lawyers and pupils in chambers from Peninsular Malaysia who arrive more than 15 minutes late, are not present throughout the event, or leave before its scheduled end.

The personal information that you provide to the Malaysian Bar, whether now or in the future, may be used, recorded, stored, disclosed or otherwise processed by or on behalf of the Malaysian Bar for the purposes of facilitation and organisation of this event, research and audit, maintenance of a participant database for the promotion of this event, and such ancillary services as may be relevant.
