Description
Despite significant construction activities across the East Coast, Kedah and Perlis, statistics indicate that the number of CIPAA (Construction Industry Payment and Adjudication Act 2012) claims originating from these regions remains comparatively low, given the volume and value of projects undertaken. This disparity may reflect a gap in awareness, accessibility or understanding of CIPAA as an effective mechanism for payment recovery and dispute
resolution.
To address this, the Bar Council Arbitration and Construction Law Committee (“ACLC”), in collaboration with the Kelantan Bar, proposes a targeted outreach programme to empower industry stakeholders with practical knowledge of CIPAA.
This programme seeks to:
• raise awareness of CIPAA among contractors, consultants, developers and legal practitioners;
• provide clarity on the procedural framework and practical application of adjudicationm proceedings;
• promote CIPAA as a swift, cost-effective and efficient avenue for resolving payment disputes;
• enhance understanding of post-adjudication enforcement mechanisms and strategic considerations; and
• encourage wider utilisation of CIPAA to improve cash flow management and payment practices within the construction industry.
Through this initiative, ACLC aims to foster greater confidence in statutory adjudication and
contribute towards a more sustainable, efficient and payment-secure construction industry.
