There really seems to be no fiscal incentive to solve problems for clients fast. But is that old-thinking?

There are observable changes in the dispute resolution market and demands for intelligent workable methodologies are picking up. Will the current and future problem-solver anticipate the presumption of mediation as a first step to dispute resolution? The International Centre for Dispute Resolution (“ICDR”) Mediation Rules 2021 incorporated a presumption of mediation in its Arbitration rules. International Centre for Settlement of Investment Disputes (“ICSID”) is discussing the proposed ICSID Mediation Rules in the next few months. Why is mediation now the talk of the international town? This session addresses the whats and whys of mainstreaming mediation and the hows of exploring a sustainable practice from this.

Speaker

Shanti Abraham, the founder of Shanti Abraham & Associates, has been in practice for over 25 years. She is a litigator, arbitrator, adjudicator and mediator. Her areas of practice include corporate and restructuring work, contractual, and commercial and construction disputes among others. Shanti is a Singapore International Mediation Institute (“SIMI”) Certified Mediator (Level 4), and has a public profile on the SIMI Mediator website. She is a mediator with, and Chair of
the International Mediation Institute (“IMI”). She is a mediator on the panels of the Securities Industriy Dispute Resolution Center (“SIDREC”), Malaysian Mediation Centre (“MMC”), and Singapore Mediation Centre (“SMC”). She is an ambassador of the Singapore International Mediation Centre. She is on the panels of arbitrators, adjudicators, and mediators with the Asian International Arbitration Centre (“AIAC”).

She has been trained in Mediation and Advanced Mediation Training — Mediating Complex Disputes at Harvard Law School and Investor-State Mediation by the Department of Justice Hong Kong. She has trained a broad range of professionals on mediation skills, including the Brunei and Myanmar Judiciary. She regularly mediates both in Malaysia and Singapore in many industries including family, matrimonial and child-inclusive mediation, and has conducted tech-enabled cross-border/online mediations.

Terms and Conditions

Event Policy

Places are limited and registration is on a first-come, first-served basis.

For events with registration fees, all payments must be made in advance, including bank charges. Registration will be confirmed once proof of payment is provided by email or fax, and full payment is received.

For events that are not organised by Bar Council, please note that you are subject to the relevant terms and conditions specified by the external providers.

Cancellation 

Cancellations must be made in writing.

If you have failed to inform the organiser on your cancellation for three consecutive times, you may be blacklisted for future events.

Refunds 

Refunds will be processed after the event is completed. This may take up to 30 business days. The conditions for refunds are as follows:

  • Full refunds will be issued if the event is cancelled or postponed by the organiser due to some circumstances.
  • No refunds for this course. However substitution is allowed.

The organiser reserves the right to modify, cancel or postpone the event, should circumstances arise that make such action necessary, whereupon all registration fees paid will be refunded.

Transferral

You are allowed to transfer your place to another participant, but you must notify the organiser with the necessary details.

Attendance 

CPD points will not be awarded to lawyers and pupils in chambers from Peninsular Malaysia who arrive more than 15 minutes late, are not present throughout the event, or leave before its scheduled end.

Privacy 

The personal information that you provide to the Bar Council, whether now or in the future, may be used, recorded, stored, disclosed or otherwise processed by or on behalf of the Bar Council for the purposes of facilitation and organisation of this event, research and audit, maintenance of a participant database for the promotion of this event, and such ancillary services as may be relevant.
