Is Emerging Technology Submerging the Bar?

With the advent of broadband, cloud services and other new technological features, traditional law practice has changed which inadvertently affects bar associations (“Bar”). This essay begins with a brief discussion of the three main functions of the Bar and thereafter to identify four emerging technologies that could potentially cover or obscure those functions. It then seeks to argue that emerging technology is not submerging the Bar in view of the overarching if not irreplaceable responsibilities of which the Bar assumes in protecting the legal profession, upholding public advocacy and preserving competent representation.

Images and texts of men in the media play a key role in reflecting and reproducing scripts of masculinity which influence men greatly in guiding their everyday masculine’s roles. This article discusses the various forms of men’s health that are promoted in Men Health Malaysia a leading lifestyle magazine for men in the country. The findings are based on an analysis of 86 articles across two issues of Men Health Malaysia magazine in January and February 2015.

Should Law Lectures be Allowed to Teach and Practice at The Same Time? A Look at the Regulatory Framework in Malaysia

Rule 44(b) of the Legal Profession (Practice and Etiquette) Rules 1978 provides that and advocate and solicitor shall not be a full-time salaried employee of any person, firm (other than advocate and solicitor or firm of advocates and solicitor). A breach of this rule constitutes ‘misconduct’ and may be struck of the Roll of advocates and solicitors or suspended from practice for any period not exceeding five years. The way law school teaches law has come under intense criticism. Law schools have often stressed the doctrinal aspects of the law while ignoring practical skills. This essay discusses the aspects of law lectures, practice and the benefits for the legal education and practice.

Activity Detrimental to Parliamentary Democracy

In 2012, the government introduced a raft of amendments to Section 124 of the Penal Code under the chapter on offences against the state. These created offences that are ‘detrimental to parliamentary democracy’. In Malaysia, the Constitution is supreme than Parliament. There are limits to Parliament’s powers. This article discusses activity detrimental to parliamentary democracy defined as activity designed to overthrow or undermine parliamentary democracy by violent or unconstitutional means.

A Mere Matter of Words

The Titular Roman Catholic Archbishop of Kuala Lumpur moved for judicial review as they were dissatisfied with the Home Minister’s refusal to permit Herald to use the word of “Allah”. Under our constitution there are two ways in which a legislature – state or federal – may violate the provisions of the Federal Constitution. Was the judge in the case of Archbishop correct in describing what was being done as ‘collateral’? If she was not, then what she said was a mere matter of words.
