CPD Camps | An Introduction to Medical Negligence In Malaysia

In this talk, the speaker hopes to introduce young Members of the Bar to medical negligence in Malaysia, an area of practice which in recent times has become a fast-growing area of the law.

Covering the basic principles and the applicable jurisprudence, the main components of a claim involving medical malpractice will be discussed. There will be a question-and-answer session at the end of this talk.

This talk is also aimed at providing a forum for discourse for interested young Members with a leaning towards this area of legal practice.

Description

Topics to be covered during the talk are:

  • Four elements of medical negligence;
  • Duty of Care — General;
  • Duty of Care — Advice;
  • Duty of Care — Diagnosis, Treatment and Management;
  • The “Bolam” test and the “Bolitho” test;
  • Causation;
  • Damages;
  • Aggravated damages; and
  • Trends of awards.

Speaker

Maidzuara Mohamad is an Utter Barrister of Gray’s Inn, one of the four Inns of Court of the Bar in England and Wales. In 1990, she was admitted as an advocate and solicitor of the High Court of Malaya.

She was in practice for almost 30 years and was involved in various areas of the law, with an emphasis on medico-legal matters for the last 10 years of her practice.

In 2020, Maidzuara left legal practice to contribute to the Judiciary.

In February 2023, Maidzuara joined Azim, Tunku Farik & Wong as a consultant. She works with one of the partners, T Tharumarajah, in the medio-legal department of the firm.

Terms and Conditions

Event Policy

Places are limited and registration is on a first-come, first-served basis. The registration for this session will close on 14 May 2025 (Wednesday), at 12:00 pm.

For events with registration fees, all payments must be made in advance, including bank charges. Registration will be confirmed once proof of payment is provided by email or fax, and full payment is received.

The organiser reserves the right to modify, cancel or postpone the event, should circumstances arise that make such action necessary, whereupon all registration fees paid will be refunded.

Cancellation

Cancellations must be made in writing.

Please note that there will be no refunds for cancellations, but substitutions are allowed. Kindly inform us in writing with the relevant details at least three days in advance.

If you have failed to inform the organiser on your cancellation for three consecutive times, you may be blacklisted for future events.

Transferal

You are allowed to transfer your place to another participant, but you must notify the organiser with the necessary details at least three days in advance.

Attendance

CPD points for CPD Scheme will not be awarded to lawyers and pupils in chambers from Peninsular Malaysia who arrive more than 15 minutes late, are not present throughout the event, or leave before its scheduled end.

Privacy

The personal information that you provide to the Bar Council, whether now or in the future, may be used, recorded, stored, disclosed or otherwise processed by or on behalf of the Bar Council for the purposes of facilitation and organisation of this event, research and audit, maintenance of a participant database for the promotion of this event, and such ancillary services as may be relevant.
