Description

“GO DIRECTLY TO JAIL. DO NOT PASS GO. DO NOT COLLECT $200.” – Mr Monopoly

Committal proceedings empower the courts to hold a person in contempt. This may be for refusing to obey a court order, or, in rarer instances, for undermining the due administration of justice.

The procedures that underlie committal applications are generally contained in Order 52 of the Rules of Court 2012 (“ROC”). A substantial supplement to ROC 2012 is drawn from common law.

Through this talk, the speaker will address the following topics:

  1. Applications for committal — Order 52 of ROC 2012;
  2. Requirement for a penal notice — Order 45, rule 7 of ROC 2012;
  3. When the court can cite for contempt of its own motion;
  4. Discussion of the procedural aspects of committal applications — what must and must not be in the papers, which documents are to be filed, etc;
  5. Applications to set aside the grant of leave;
  6. Common pitfalls;
  7. What happens after a person is cited for contempt;
  8. Sentencing; and
  9. Mitigating factors.

This seminar seeks to expound upon the finer points of committal applications — a necessary evil at the best of times. There will also be a question-and-answer session at the end of the seminar.
