Aviation law covers airports and aircraft operations, financing and licensing for airports and aircraft operations, accident investigation, as well as carriers’ liability and passenger rights. Changes can be expected in the Malaysian aviation law landscape in light of the anticipated dissolution of the Malaysian Aviation Commission (“MAVCOM”) to pave way for its functions to be absorbed by the Civil Aviation Authority of Malaysia (“CAAM”). Join the speaker as she discusses this fascinating area of law to get an overview of the regulatory framework that regulates the industry and common issues for consideration.
Speaker
Lai Wai Fong is a partner of the dispute resolution department of Shearn Delamore & Co. She has experience in corporate and commercial disputes, insurance disputes, tort, aviation disputes and land litigation. She appears regularly in the High Court, Court of Appeal and Federal Court as Counsel for trials and appeals and is involved regularly in complex and high profile matters.
Wai Fong graduated with a Bachelor's degree in Law (LL.B) from University of London in 1998 and obtained a Second Class Upper Honours. There, she was awarded the Book Prize for constitutional law and for outstanding performance. She completed the Certificate of Legal Practice (“CLP”) in 1999 and was awarded the Book Prize for the law of evidence.
She was admitted to the High Court of Malaya in 2000 as an advocate and solicitor. She is a member of the Bar Council Advocacy Training Committee, and has been an advocacy trainer since 2016.
She has been involved in complex and high profile matters, including aviation matters such as:
MH370 and MH17 litigation against Malaysia Airlines
She acted for the administrator of Malaysia Airlines in respect of certain claims arising from the MH370 incident and claims filed by the crew of Malaysia Airlines arising from the MH17 incident, respectively.
Landmark aviation decision in All Nippon Airways Co Ltd v Tokai Marine & Trading
This is the first judgment of the Malaysian Court of Appeal, sitting as an apex court, which affirmed the application of the Warsaw Convention in the Malaysian landscape for the first time. This remains the only reported judgment of an apex Court on the effect of the Warsaw Convention in a Malaysian context.
Terms and Conditions
Event Policy
Places are limited and registration is on a first-come, first-served basis.
For events with registration fees, all payments must be made in advance, including bank charges. Registration will be confirmed once proof of payment is provided by email or fax, and full payment is received.
For events that are not organised by Bar Council, please note that you are subject to the relevant terms and conditions specified by the external providers.
Cancellation
Cancellations must be made in writing.
If you have failed to inform the organiser on your cancellation for three consecutive times, you may be blacklisted for future events.
Refunds
Refunds will be processed after the event is completed. This may take up to 30 business days. The conditions for refunds are as follows:
- Full refunds will be issued if the event is cancelled or postponed by the organiser due to some circumstances.
- No refunds for this course. However substitution is allowed.
The organiser reserves the right to modify, cancel or postpone the event, should circumstances arise that make such action necessary, whereupon all registration fees paid will be refunded.
Transferral
You are allowed to transfer your place to another participant, but you must notify the organiser with the necessary details.
Attendance
CPD points will not be awarded to lawyers and pupils in chambers from Peninsular Malaysia who arrive more than 15 minutes late, are not present throughout the event, or leave before its scheduled end.
Privacy
The personal information that you provide to the Bar Council, whether now or in the future, may be used, recorded, stored, disclosed or otherwise processed by or on behalf of the Bar Council for the purposes of facilitation and organisation of this event, research and audit, maintenance of a participant database for the promotion of this event, and such ancillary services as may be relevant.
