Description
Lately, there have been several key developments in medico-legal matters, and as legal practitioners, it is vital to keep abreast of such developments which shape our practice accordingly. In this session, the speakers will delve into and examine recent medico-legal decisions across different jurisdictions, examining the possible impact these decisions may have on the medico-legal landscape.
Speaker
Charlaine Adrienne Chin was called to the Utter Bar of England and Wales, and is currently an advocate and solicitor of the High Court of Malaya and partner at Raja, Darryl & Loh.
She conducts trials and appeals at various levels of the Malaysian courts and the bulk of her practice thus far has been in medico-legal cases, representing medical practitioners in civil suits as well as in disciplinary inquiries before the Malaysian Medical Council.
She was part of the team that was involved in successfully defending a host of landmark medical negligence appeals at the Federal Court, which clarified the issues of standard of care in respect of a doctor’s duty to diagnose and treat, and a doctor’s duty to advise of risks.
On the corporate and commercial front, she currently represents public listed corporations, private companies, and individuals in tortious and contractual claims at all levels of the court involving, among others, sale of goods, oil and gas disputes, automobile-related disputes and injunctive proceedings. Her dispute resolution experience also encompasses arbitration and mediation.
Cheong Chi Yan is a legal associate at Raja, Darryl & Loh. She completed the Bar Professional Training Course at BPP Law School in Leeds (2018–2019) and earned a Bachelor of Law (LLB) from the University of Essex (2017–2018). Chi Yan was admitted to the Utter Bar of England and Wales as a Barrister-at-Law and as a member of the Honourable Society of Lincoln's Inn in 2019.
She actively handles medico-legal and civil litigation files, meeting clients and experts to gather instructions, attending medical inquiries with a supervising partner, as well as advising clients on legal matters.
Sofiya Imran is an associate at Raja, Darryl & Loh since 2023. She holds a LLB in Law with Criminology from the University of Manchester in 2016. Sofiya completed the Bar Professional Training Course at the University of Law (London) in 2017, and earned an LLM in Medical Law from Queen Mary University of London in 2018.
She was admitted to the Utter Bar of England and Wales as a Barrister-at-Law and as a member of the Honourable Society of Gray’s Inn in 2017. She was admitted as an advocate and solicitor of the High Court of Malaya in 2023.
She currently actively handles medico-legal and civil litigation files. The majority of her practice includes representing medical practitioners in civil suits, in addition to representing medical and dental practitioners in inquiry proceedings before the Malaysian Medical Council (“MMC”) and the Malaysian Dental Council (“MDC”).
Her professional employment also includes serving as a lecturer in law at HELP University.
Terms and Conditions
Event Policy
Places are limited and registration is on a first-come, first-served basis.
For events with registration fees, all payments must be made in advance, including bank charges. Registration will be confirmed once proof of payment is provided by email or fax, and full payment is received.
For events that are not organised by Bar Council, please note that you are subject to the relevant terms and conditions specified by the external providers.
Cancellation
Cancellations must be made in writing.
If you have failed to inform the organiser on your cancellation for three consecutive times, you may be blacklisted for future events.
Refunds
Refunds will be processed after the event is completed. This may take up to 30 business days. The conditions for refunds are as follows:
- Full refunds will be issued if the event is cancelled or postponed by the organiser due to some circumstances.
- No refunds for this course. However substitution is allowed.
The organiser reserves the right to modify, cancel or postpone the event, should circumstances arise that make such action necessary, whereupon all registration fees paid will be refunded.
Transferral
You are allowed to transfer your place to another participant, but you must notify the organiser with the necessary details.
Attendance
CPD points will not be awarded to lawyers and pupils in chambers from Peninsular Malaysia who arrive more than 15 minutes late, are not present throughout the event, or leave before its scheduled end.
Privacy
The personal information that you provide to the Bar Council, whether now or in the future, may be used, recorded, stored, disclosed or otherwise processed by or on behalf of the Bar Council for the purposes of facilitation and organisation of this event, research and audit, maintenance of a participant database for the promotion of this event, and such ancillary services as may be relevant.
