Misconduct is never acceptable in the workplace and naturally, no employer should have to retain an employee who is guilty of misconduct. However, many employers still find themselves on the wrong side of the law and are faced with an Industrial Court award against them. During this session, the speaker will explore the acceptable grounds for dismissal, the process that should be undertaken and steps to mitigate the risks of an unjust dismissal finding.
Speaker
Selvamalar Alagaratnam heads Skrine’s employment practice. She provides integrated support to clients in various industries on all employment / human resource related matters, including compliance with all laws applicable to employment relationships; managing the exit of employees whether by way of collective reduction in force exercises or individual terminations for misconduct or poor performance; protection of confidential and proprietary information; investigations and disciplinary actions; trade unions, both recognition and collective bargaining; dispute resolution at all levels; and business immigration.
She assists corporations in managing and navigating the social criteria in environmental, social and governance (“ESG”) requirements, providing guidance on business and human rights. She is currently a facilitator for the Leading for Impact (“LIP”) programme conducted by the Institute of Corporate Directors Malaysia (“ICDM”) on this issue.
She also provides strategic advice in internal fraud management advising clients in high profile and highly sensitive matters involving fraud perpetrated by employees; and the options available to the organisations to obtain redress against wrongdoers.
Her practice extends to focused compliance on bribery and corruption. Her client base is spread across various sectors and includes regulators.
Terms and Conditions
Event Policy
Places are limited and registration is on a first-come, first-served basis. The registration for this session will close on 19 May 2025 (Monday), at 12:00 pm.
For events with registration fees, all payments must be made in advance, including bank charges. Registration will be confirmed once proof of payment is provided by email or fax, and full payment is received.
The organiser reserves the right to modify, cancel or postpone the event, should circumstances arise that make such action necessary, whereupon all registration fees paid will be refunded.
Cancellation
Cancellations must be made in writing.
Please note that there will be no refunds for cancellations, but substitutions are allowed. Kindly inform us in writing with the relevant details at least three days in advance.
If you have failed to inform the organiser on your cancellation for three consecutive times, you may be blacklisted for future events.
Transferal
You are allowed to transfer your place to another participant, but you must notify the organiser with the necessary details at least three days in advance.
Attendance
CPD points for CPD Scheme will not be awarded to lawyers and pupils in chambers from Peninsular Malaysia who arrive more than 15 minutes late, are not present throughout the event, or leave before its scheduled end.
Privacy
The personal information that you provide to the Bar Council, whether now or in the future, may be used, recorded, stored, disclosed or otherwise processed by or on behalf of the Bar Council for the purposes of facilitation and organisation of this event, research and audit, maintenance of a participant database for the promotion of this event, and such ancillary services as may be relevant.
