Description
The speakers will give an overview of the mental capacity issues vexing Malaysians, including the relevant jurisprudence; the necessity of a Mental Capacity Act (“MCA”) that is separate from the Mental Health Act 2001; the MCA’s importance to vulnerable persons, including persons with disabilities; and our Wish List.
Speaker
Trevor Jason Mark Padasian was admitted as an advocate and solicitor of the High Court of Malaya in 1993, having been admitted as a barrister and solicitor of the Supreme Court of Victoria, Australia, in 1991. He is a partner of Skrine in its dispute resolution department and has, over the years, handled the full range of civil litigation matters including personal (bankruptcy) and corporate insolvency disputes as well as matrimonial disputes. He has given talks on the foregoing areas to the Bar, corporate managements, and professional bodies (including those of the banking industry), amongst others. Trevor is a mediator on the Panel of Accredited Mediators of the Malaysian International Mediation Centre; a member of the Disciplinary Committee Panel of the Advocates and Solicitors Disciplinary Board; and a member of the Bar Council Family Law Committee, Bar Council Mediation Committee, Bar Council Civil Law and Law Reform Committee and Bar Council MyBar Ageing Advisory Committee.
Shanti Abraham is a lawyer of over 30 years standing. She is the immediate past President of the Medico-Legal Society of Malaysia and is the co-chair of the Bar Council Mental Capacity Subcommittee, which was formed under the Bar Council Civil Law and Law Reform Committee.
She has an active corporate and dispute resolution legal practice in Kuala Lumpur. In the last nearly 25 years, her legal practice has focused on healthcare matters ranging from corporate matters to dispute resolution, including healthcare mediation and negotiation.
Shanti is an arbitrator, mediator and adjudicator with various institutions in Malaysia and overseas. She is a Healthcare Mediator with the Singapore Mediation Centre where she is a Principal Mediator and an International Mediator. She has trained doctors and other professionals in mediation and promotes early neutral evaluation. She has also trained and advised subject-matter experts for both court appearances and mediation involvement.
She organised the Mental Capacity Act forum with Bahagian Hal Ehwal Undang-Undang (“BHEUU”) in 2024 and continues to advocate the need for a Mental Capacity Act together with a Vulnerable Persons Act and advance medical instructions and supports educational directives for awareness building.
Farah Deba Mohamed Sofian is a lawyer with over 30 years of legal practice. She is a senior partner of Wong Lu Peen & Tunku Alina, the current STEP Malaysia Chairperson since 2016, an accredited mediator registered with the Malaysian International Mediation Centre and a trained Collaborative Law practitioner. She sits on various committees like the Bar Council MyBar Ageing Rights Advisory (“MBARA”) Committee, Bar Council Mental Capacity Subcommittee formed under the Bar Council Civil Law and Law Reform Committee and One Heart Foundation Malaysia. Farah also currently sits as an independent director on the board of a few public listed companies.
Her main practice area is trust, inheritance and succession laws affecting Muslims and non-Muslims. She advises founders in asset planning, which includes family business succession matters and provides services to personal representatives in administering estates. Her clientele come from all walks of life, including individuals of various economic status, entrepreneurs, professional trustee companies, beneficiaries, legal heirs, widows and orphaned children. Her private client services also extend to charitable and philanthropic work and to protecting vulnerable persons, including adults with disabilities and elderly clients.

Event Policy
Places are limited and registration is on a first-come, first-served basis. The registration for this session will close on 12 Dec 2025 (Friday), at 5:00 pm.
For events with registration fees, all payments must be made in advance, including bank charges. Registration will be confirmed once proof of payment is provided by email or fax, and full payment is received.
The organiser reserves the right to modify, cancel or postpone the event, should circumstances arise that make such action necessary, whereupon all registration fees paid will be refunded.
Cancellation
Cancellations must be made in writing.
Please note that there will be no refunds for cancellations, but substitutions are allowed. Kindly inform us in writing with the relevant details at least three days in advance.
If you have failed to inform the organiser on your cancellation for three consecutive times, you may be blacklisted for future events.
Transferal
You are allowed to transfer your place to another participant, but you must notify the organiser with the necessary details at least three days in advance.
Attendance
CPD points for CPD Scheme will not be awarded to lawyers and pupils in chambers from Peninsular Malaysia who arrive more than 15 minutes late, are not present throughout the event, or leave before its scheduled end.
Privacy
The personal information that you provide to the Malaysian Bar, whether now or in the future, may be used, recorded, stored, disclosed or otherwise processed by or on behalf of the Malaysian Bar for the purposes of facilitation and organisation of this event, research and audit, maintenance of a participant database for the promotion of this event, and such ancillary services as may be relevant.
