Practical Aspects on How Law Firms Can Manage Dawn Raids

The Committee on AMLA has recently received numerous complaints from Members of the Bar relating to dawn raids conducted by the Malaysian Anti-Corruption Commission (“MACC”) and/or the Inland Revenue Board (“IRB”) in the course of their investigations under the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001.

During the course of these raids by MACC and/or IRB, Members of the Bar experienced mobile phones and other critical items seized, unlawful requests to access files, documents, financial statements and information, threats of arrest and an array of intimidation tactics. Notwithstanding that Members of the Bar are merely fulfilling their professional obligations in representing clients, going through the dawn raid process can be a harrowing experience.

Speaker

Karen Cheah Yee Lynn is the Immediate Past President of the Malaysian Bar. Her presidential term was from March 2022 to March 2024. She was the Chairman of the Malacca State Bar Committee from 2012 to 2015 and has been a Bar Council Member since 2012. She was appointed as the Treasurer of the Malaysian Bar for the terms 2013/2014 and 2014/2015. Following this, she served as the Secretary of the Malaysian Bar for the terms 2015/2016 and 2016/2017. She is the current Chairperson of the Bar Council Committee on AMLA, the Bar Council International Affairs Committee, and the Bar Council LAWASIA Conference 2024 Organising Committee, which oversees the 37th LAWASIA Conference at Hilton Kuala Lumpur from 13 to 15 Oct 2024, in Malaysia.

 

Ravi Chandran is the sole proprietor of Messrs SC Ravi & Associates. He was admitted to the High Court of Malaya as an Advocate and Solicitor in 2003 and has over 20 years of experience conducting criminal and civil trials in the Subordinate Courts and High Courts, as well as Appeals in all the Appellate Courts. He has been an active member of the Penang Bar Committee, serving from 2015 to 2022. Currently, he holds the position of Penang Bar Representative to the Bar Council for 2024/2025, Co-Chairperson of the Criminal Committee, Co-Chairperson of the National Legal Aid and YBGK Committee, and Deputy Chairperson of the Professional Indemnity Committee.

 

Vivek Sukumaran has experience in handling litigation matters involving constitutional disputes (political parties and societies), corporate and commercial disputes, land acquisition, corporate recovery, insolvency, debt recovery and employment disputes in all courts. He has also taken cases for and against insurance institutions. He also defends white-collar criminal prosecutions involving the Malaysian Securities Commissions (SC) and the Malaysian Anti-Corruption Commission (MACC). He is the founding partner of Messrs Asyraf, Vivek & Wee, Kuala Lumpur. He is the Kuala Lumpur Bar Representative on the Bar Council for the term 2024/2025. Before this, Vivek was the Chairman of the Kuala Lumpur State Bar Committee for terms 2021/2022 and 2022/2023. He is the current Co-Chairperson of the Bar Council Criminal Law Committee for the term 2024/2025 and the Strategic Litigation Committee for the term 2024/2025.

Terms and Conditions

Event Policy

Places are limited and registration is on a first-come, first-served basis.

For events with registration fees, all payments must be made in advance, including bank charges. Registration will be confirmed once proof of payment is provided by email or fax, and full payment is received.

For events that are not organised by Bar Council, please note that you are subject to the relevant terms and conditions specified by the external providers.

Cancellation 

Cancellations must be made in writing.

If you have failed to inform the organiser on your cancellation for three consecutive times, you may be blacklisted for future events.

Refunds 

Refunds will be processed after the event is completed. This may take up to 30 business days. The conditions for refunds are as follows:

  • Full refunds will be issued if the event is cancelled or postponed by the organiser due to some circumstances.
  • No refunds for this course. However substitution is allowed.

The organiser reserves the right to modify, cancel or postpone the event, should circumstances arise that make such action necessary, whereupon all registration fees paid will be refunded.

Transferral

You are allowed to transfer your place to another participant, but you must notify the organiser with the necessary details.

Attendance 

CPD points will not be awarded to lawyers and pupils in chambers from Peninsular Malaysia who arrive more than 15 minutes late, are not present throughout the event, or leave before its scheduled end.

Privacy 

The personal information that you provide to the Bar Council, whether now or in the future, may be used, recorded, stored, disclosed or otherwise processed by or on behalf of the Bar Council for the purposes of facilitation and organisation of this event, research and audit, maintenance of a participant database for the promotion of this event, and such ancillary services as may be relevant.
