Description
Practical Aspects on How Law Firms Can Manage Dawn Raids
The Committee on AMLA has recently received numerous complaints from Members of the Bar relating to dawn raids conducted by the Malaysian Anti-Corruption Commission (“MACC”) and/or the Inland Revenue Board (“IRB”) in the course of their investigations under the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001.
During the course of these raids by MACC and/or IRB, Members of the Bar experienced mobile phones and other critical items seized, unlawful requests to access files, documents, financial statements and information, threats of arrest and an array of intimidation tactics. Notwithstanding that Members of the Bar are merely fulfilling their professional obligations in representing clients, going through the dawn raid process can be a harrowing experience.
This webinar will cover several key objectives, including understanding what constitutes a dawn raid, the legal provisions and protocols involved, the rights and responsibilities of law firms during a raid, and practical steps pre-raid, during the raid and post-raid. We will also discuss how law firms can ensure client confidentiality and protect privileged information, managing MACC and IRB officers during the raid, the powers and purview of MACC and IRB conducting such raids and provide mechanisms to support law firms.
This webinar is essential for all legal practitioners and staff of law firms. We urge all Members of the Bar to attend this important session to better understand your rights and the correct procedures to follow during a dawn raid.
Let us work together to uphold the integrity of our profession and ensure that our duties are performed without undue interference.
