Judicial Separation as Opposed to Divorce- Practicalities and Procedures

The talk will cover Section 48 of the Law Reform(Marriage & Divorce) Act, 1976, and the jurisdiction and power of the Courts to grant a Decree of Judicial Separation; Section 64, 65 & 66 of the Law Reform(Marriage & Divorce) Act 1976, on the Grounds for Judicial Separation; the Legal effect of a grant of Judicial separation, as opposed to a Decree for Divorce; when it may be necessary or advantageous to file for Judicial Separation rather than for Divorce and; Ancillary Relief that the Court may grant, in proceedings for Judicial Separation; and relevant sections of the Act as well as relevant Case Law.

Speaker

Balwant Singh Sidhu aas called to the English Bar in 1982 and to the Malaysian Bar in 1983, and has been in active practice for almost 35 years, specializing in Family Law, and is the sole proprietor of Balwant Singh Sidhu & Co. He has been an External Tutor and Examiner for Civil Procedure, for the Certificate In Legal Practice. He has been called Ad Hoc to the Bar of the Supreme Court of Brunei Darussalam as Senior Counsel in 2002, 2004 and in 2010.

He was the Contributing Editor, (in 1995) for The Annotated Statutes of Malaysia, (Malaysia Law Journal) for The Law Reform (Marriage & Divorce) Act, 1976. He has also been a Speaker at Law Conferences and State Bars on Family Law, and has also given Opinions to the Family Court of Melbourne, Australia, and to law firms in the U.K. and in Singapore, and has published articles on Family Law in the Malayan Law Journal.
