Description

This seminar is divided into 4 sessions:

  1. An Overview by Sharon Palani
  2. Session on Doctors – Maidzuara Mohammed
  3. Session on Private Hospitals – Mr. Felix Raj. Brief outline:The critical issues facing private hospital today concerns the common law principles of vicarious liability and breach of non-delegable duty of care despite the consultant doctors being engaged as independent contractors.
  4. Session on Governments Doctors & Hospitals – Mr. Ramakrishna Tharini. Brief outline:Clinical negligence claims involving the Government, whilst substantively similar to claims against private entities, does involve significant procedural differences. This session aims to explore these differences, which include matters such as limitation, naming of parties and expert evidence.

Speaker

Maidzuara Mohammed practices  as a partner in Messrs Raja, Darryl & Loh. Called to the Bar in  1990.

Her area of expertise lies in the field of Civil Litigation, Commercial & Corporate Litigation and Medico-legal defence and advisory (medical practitioners and private healthcare). Appears in sub-ordinate Courts, High Court,  Court of Appeal and Federal Court both as counsel and second chair including in the area of medico-legal.  Also  represented medical practitioners in respect of inquiries before statutory authorities such as the Malaysian Medical Council.

Felix Raj has been practice in excess of 22 years and is now the founding partner and sole proprietor of Felix Raj Chambers.

He has been involved in various medical malpractice matters at all levels of the Malaysian Judiciary and has conduct of a number of complicated medical negligence cases. Felix is also a regular speaker at internal conferences and practical day to day workshops at hospitals to assist in improving their risk management profile and as continuing education for nurses and medical officers.

Ramakrishna Tharini graduated in medicine from Queen Mary University of London in 2010. A strong inclination towards the law led him to pursue a post-graduate diploma in law at City University, London (now known as City, University of London). He was thereafter called to the English Bar at the Honourable Society of Lincoln’s Inn.

Ramakrishna was admitted as an Advocate & Solicitor of the High Court of Malaya in October 2015. He commenced practice at a Kuala Lumpur-based law firm renowned for its expertise in medical law and was involved in the conduct of numerous clinical negligence claims, acting for a wide range of clients including patients, healthcare practitioners, hospitals and professional indemnity providers. In October 2017, Ramakrishna co-founded Messrs Ram & Low and continues to practice mainly in the field of clinical negligence litigation.
