The Bar Council National Young Lawyers and Pupils Committee (“NYLPC”) is organising a workshop entitled “Personal Data Protection Act 2010 and the PDPA Code of Conduct”. This workshop will provide an overview of the Personal Data Protection Act 2010 (“PDPA”), and the relevant regulations and standards together with the Code of Conduct applicable to legal practitioners. The speaker will discuss core principles, compliance issues, and recent enforcement actions taken in Malaysia.

Chew Kherk Ying heads the intellectual property (“IP”) and dispute resolution practice groups at her law firm, with close to 30 years of experience in advising on IP, commercial litigation, corporate compliance, information technology (“IT”) and internet regulatory matters.
She has experience in technology-related matters, IT contracts and outsourcing agreements, know-how and design contracts, distributorships, data privacy and protection, as well as commercial and regulatory issues concerning e-commerce, social media and online platforms, telecommunications, cloud computing, and cybersecurity.
Kherk Ying has advised and assisted with the implementation of a comprehensive data privacy compliance programme for both Malaysian and multinational companies across various industries. She has advised on a wide range of issues with respect to the application and regulatory requirements of Malaysia's data privacy laws, including the processing of employee and customer data, the cross-border transfer and disclosure of such data, as well as the appointment of data processors.
Kherk Ying serves on the Bar Council Ad Hoc Personal Data Protection Committee, and is ranked as a Tier 1 practitioner in the area of IP in Malaysia by Chambers Asia-Pacific and Legal 500 Asia Pacific. She has been recognised as a 2018 Acritas Star in Dispute Resolution, as “Best in IP Litigation” by Euromoney Asia Women in Business Law Awards 2017, and was named among the Commended External Counsels of the Year 2017 by the In-House Community. She was also one of two Malaysians ranked in the Top 250 Women in IP 2017 by Managing Intellectual Property.
Kherk Ying is the author of the chapter on “IT Contracts” in Bullen & Leake & Jacob’s Malaysian Precedents of Pleadings, published in September 2017, and co-author of the “Guidance Note on Health and Pharma in Malaysia” for DataGuidance, a global privacy compliance resource.
