The Service Tax 2018 will take effect on 1 September 2018 mandatory requiring all legal firms with annual turnover of RM500,000 to be registered with the Royal Malaysian Customs (RMC). Service Tax unlike Goods and Services Tax (GST), need only accounted for every two calendar months with payments received from customers. Invoices issued to the customers however remain as services provided to customers.
Choong Kwai Fatt, PhD, is a tax specialist and tax advocate in Malaysia. He practises law under the firm, Kwai Fatt & Associates, which specialises in income tax and goods and services tax (GST) appeals besides providing consultancy and support in income tax matters, particularly on transfer pricing, tax audit and investigation, and trust and will matters. Dr Choong was an associate professor with the University of Malaya for 19 years. He has published a total of 60 books on Malaysian Taxation, including 10 on the Goods and Services Tax (GST), and 6 on the Companies Act 2016. His research has been quoted in many tax cases before the High Courts and by the Special Commissioners of Income Tax.
