Mediation is encouraged in all areas of litigation now. It is especially important when it comes to family matters where emotions run high.
Parties are often coping with betrayal, a sense of failure, shame and financial insecurity. Where children are involved, parties need to accept that while their marriages have irretrievably broken down, their relationships with their children ought to be intact and their care should be prioritised.
Litigation is not best suited to deal with all those issues.
When parties are successful at mediation, they will be focused on the best way to move forward with co-parenting and agree on financial arrangements. Mediation may also result in parties re-starting a healthier way to communicate.
