Understanding Family Mediation and Preparing Your Clients

Mediation is encouraged in all areas of litigation now. It is especially important when it comes to family matters where emotions run high. Parties are often coping with betrayal, a sense of failure, shame and financial insecurity. Where children are involved, parties need to accept that while their marriages have irretrievably broken down, their relationships with their children ought to be intact and their care should be prioritised.  Litigation is not best suited to deal with all those issues.  When parties are successful at mediation, they will be focused on the best way to move forward with co-parenting and agree on financial arrangements. Mediation may also result in parties re-starting a healthier way to communicate.  Among the topics for discussion are de-mystifying mediation, the pros and cons of private and ‘court’ mediation, managing clients’ expectations, costs, being mediation advocates and preparing clients for mediation.  This talk is best suited for those already dealing with family matters.

Speaker

Honey Tan Lay Ean has a Bachelor of Laws (LLB) from the University of Buckingham, and Master of Laws (LLM) from Warwick University. She is a Barrister of the Middle Temple and was admitted as an Advocate and Solicitor of the High Court of Malaya. She is a mediator of Malaysian International Mediation Centre focusing on family matters and a member of International Academy of Collaborative Professionals. She was the immediate past Chairperson of the Family Law Committee and Women’s Rights Committee.
