Terms and Conditions

1. Ordering and Despatch

1.1 You can create a shopping basket for publication(s) and event(s), and order them immediately. To complete your order you can either enter your credit card details directly onto our secure Checkout page or choose any of the other options. You will then receive an e-mail acknowledgement that your order has been sent to the Continuing Professional Development (“CPD”) Department.

1.2 Information contained on the CPD website is invitation to treat and does not constitute an offer by us to supply any event(s) and publication(s), even after your receipt of our e-mail acknowledgement of your order. Orders shall be accepted entirely at the discretion of Bar Council Malaysia and are subject to availability of the said event(s) and publication(s).

1.3 Items in stock are normally dispatched within three working days, and orders for publication(s) are normally processed once daily between Monday and Friday, excluding weekends and public holidays. Publication(s) not in stock will be listed as `Out of Stock’ and cannot be ordered until stock is available. Please use the additional `Remarks’ box on the checkout page to let us know specific details about your shipping arrangements, if any.

1.4 If we are unable to supply a particular event(s) and / or publication(s) for any reason beyond our control, we will let you know as soon as possible.

1.5 Bar Council Malaysia will charge your credit or debit card when the order is completed. If for any reason, the event(s) and / or publication(s) is unavailable thereafter, Bar Council Malaysia will prepare a refund accordingly. Please expect to receive email communications from our team about this.

1.6 Customers from East Malaysia will be charged the same prices for the event(s) and / or publication(s), however are expected to pay higher shipping charges in accordance the current rates charged by our dispatch providers. Overseas customers will be charged the Ringgit Malaysia value of the order, and Bar Council Malaysia cannot guarantee the conversion price in your local currency. This will be subject to local bank rates of exchange on the day the purchase is billed to your account.

1.7 Liability for any local charges or taxes made at the point of delivery are to be met by the customer as Bar Council Malaysia has no knowledge of particular customs and import charges in force in any country at any time, and makes no allowance in its pricing for such charges. Customers assume the role of importer for the purposes of customs and any other importation charges. Bar Council Malaysia will not be liable to the purchaser(s) for any delay or failure of the publication(s) to reach their delivery address because of the detention of a parcel by customs or other authorities.

2. Delivery Charges & Delivery

2.1 Delivery charges for Peninsular Malaysia: RM12.72 per publication (inc 6% GST).

2.2 Bar Council Malaysia shall not be liable for any loss of profit or for any indirect, special or consequential loss or damage, costs, expenses or other claims for compensation whatsoever occasioned by or arising from any delay in delivering the order, or from any failure to deliver the order.

2.3 Delivery will be made to the address specified on the order or to a carrier designated by the customer, or to other such addresses as are notified to the Supplier from time to time.

2.4 Time is not of the essence for delivery of publication(s) and Bar Council Malaysia’s liability for incorrect delivery or failure to deliver is limited to the replacement of the publication(s).

3. Prices & Payment Methods

3.1 All prices are quoted in Ringgit Malaysia and are subject to change by the publishers at any time. If the price of the event(s) and / or publication(s) becomes higher than shown on the CPD website at the time of your order, the CPD Department will advise you of that fact before confirming the order, thereby allowing you the option to cancel the order.

4. Returns & Exchanges

4.1 Bar Council Malaysia will replace faulty publication(s) on production of proof of purchase, provided that the claim is made within three (3) working days from the date of delivery of the publication(s). If you receive a faulty publication, please contact: cpd@malaysianbar.org.my to arrange the return or exchange, stating the nature of the problem. Bar Council Malaysia will not be liable for the postage cost if any publication(s) is sent back to us.

4.2 The option to cancel the order exists until the item has been dispatched. To cancel an order, please e-mail to cpd@malaysianbar.org.my with details of your request.

5. Customer Service

5.1 Any complaints that you may have can be dealt with by us and you can contact us by e-mail at cpd@malaysianbar.org.my or by telephone on +603 2050-2111.

6. Privacy & Distance Selling Regulations

6.1 In compliance with the Personal Data Protection legislation, we will only use the information that we collect about you lawfully and will not release this information to any third party for any purpose outside the sale and delivery of any publication(s) unless we have your consent to do so.

7. Law

7.1 These terms and conditions will be interpreted in accordance with the Malaysian Law.

7.2 Time is not of the essence for delivery of publication(s) and Bar Council Malaysia’s liability for incorrect delivery or failure to deliver is limited to the replacement of publication(s).

8. Loss or Damage in Transit

8.1 Claims for damage or partial delivery or complete loss of publication(s) must be notified within thirty (30) days of the date of invoice.

9. Suppliers Liability

9.1 Bar Council Malaysia’s liability to the customer for negligence, breach of contract and statutory duty shall be limited to the cost of replacing the publication(s) ordered. It is not intended that any contract between Bar Council Malaysia and the customer for the supply of publication(s) should be enforceable by any third party. Nothing in this Agreement is intended to limit liability for death or personal injury.

9.2 Bar Council Malaysia accepts no liability for any reliance placed upon the contents of any publication(s) supplied. The said material is intended for reference purposes only and are not intended, nor should they be used, as a substitute for professional advice and judgment or to provide legal advice with respect to particular circumstances.

9.3 Any waiver by Bar Council Malaysia of any of these terms and conditions shall be limited to the particular instance and shall not operate or be deemed to operate as a future waiver of that or any other term.

10. Notices

10.1 Notices sent by the customer must be sent by email to the CPD Department at cpd@malaysianbar.org.my and such notices must state the customer’s name, email contact, mobile contact number.
